Contests can be a great way for brands to have fun engaging their audiences and stimulating buzz about their products. But when launching a contest across Canada, it is important to remember that Quebec operates a little bit differently than the rest of the provinces.

Meet the Régie des alcools, des courses et des jeux. The Régie essentially ensures that contests operating in Quebec comply with laws which are designed to protect its residents.

Development of a contest starts by ensuring that it is entirely in compliance with both federal and provincial legislation.  Official rules should always be drafted and approved by a qualified legal representative. It is only after the official rules for a contest have been developed that the registration process with the Régie can officially begin.

Registration with the Régie involves some planning, paperwork and, of course, a filing fee.  The registration process is clearly outlined in the Régie’s Publicity Contest Notice.  It’s also a good idea to review the laws and regulations which govern a publicity contest in Quebec.

Depending on the structure and grand total of the prizes, the Régie may require you to:

  • Fill out a Publicity Contest Notice to register the contest at least 30 days ahead of the contest’s launch which requires the inclusion of full official rules and any advertisements.
  • Pay a filing fee, which ranges between 3-10% of the total prize value.

  • Allow the Quebec government to determine if the contest may be changed or canceled once it has started.
  • File a written report after the contest has ended, attesting that the prizes have been delivered or attempted to be delivered.
  • Agree to allow the government of Quebec to mediate any lawsuits arising from the contest.

The registration process is not as daunting as it sounds. I highly recommend reviewing all these materials thoroughly in advance.  It will save you time along the way.  And don’t forget, the Régie’s friendly staff members are always available to answer questions and point out what an application might be missing (during Eastern business hours that is).
